<p>The  federal jury in Knoxville, Tennessee this afternoon convicted   David C. Kernell, Sarah Palin&#8217;s e-mail intruder, of felony destruction of records to hamper a federal  investigation and misdemeanor unlawfully obtaining information from a  protected computer.</p>
<p>The four charges are all felonies with only the protected computer  count included a lesser misdemeanor offense. The jurors chose the  misdemeanor count of the charge. Kernell was facing a total of 50 years  in prison if convicted of all the felonies. The jury acquitted Kernell, 22, of felony wire fraud.</p>
<p>U.S. District Judge Thomas W. Phillips declared a mistrial on the  fourth charge, felony identity theft, after the jurors said they were  hopelessly deadlocked.</p>
<p>On Thursday the jurors sent a note to Phillips indicated some tension  in the group. “Some of us feel not all jurors are following jury instructions,” the  note said in part.  It will be interesting, over time, if it is learned the liberal media hysteria and hatred directed at Governor Palin played any role in this &#8216;jury tension&#8217;.</p>

<p>The President, Congressional leaders and other peddlers of deceit such as Al Sharpton and Jesse Jackson have used the media to lie about the legislation.  What they are not telling us is that it&#8217;s nothing more than a re-statement of Federal law&#8230;nothing more nothing less.</p>
<p>Unfortunately, as any thinking American knows, the Federal immigration laws are NOT being enforced.  Arizona did what the citizens of that state demanded and that&#8217;s how it should be.  Here are Sarah&#8217;s reasoned and welcomed remarks calmly delivered against a backdrop of left-wing fear mongering and hysteria.  One more reason we say&#8230;get ready America&#8230;PALIN 2012!</p>

<li style="text-align: center;"><em><span style="color: #0000ff;">A forensic probe of the computer a University of Tennessee student allegedly used to illegally snoop through former Alaska Gov. Sarah Palin&#8217;s private e-mail account presented jurors Thursday with a study in contrasts.</span></em></li>
<li style="text-align: center;"><em><span style="color: #800000;">David C. Kernell deleted everything he took from the account but left intact what amounted to a confession of his foray into the account.</span></em></li>
<li style="text-align: center;"><em><span style="color: #0000ff;">He posted a password on an Internet discussion site and urged others to use it but minutes later tried to block them from doing so and declared himself a &#8220;dip (expletive)&#8221; for making the password public.</span></em></li>
<li style="text-align: center;"><em><span style="color: #800000;">He &#8220;defragmented&#8221; the hard drive, which served to overwrite some deleted information, but never sought to reformat it, which would have effectively wiped it clean.</span></em></li>
</ul>
<p><em><span style="color: #0000ff;">Jurors in the Federal courtroom on Thursday took a journey via FBI Agent Stephen McFall&#8217;s forensic autopsy through the computer activity on Kernell&#8217;s laptop in September 2008 when the then 20-year-old UT economics major allegedly managed to Google his way past Yahoo! security measures and change the password on Palin&#8217;s private account to get inside it.</span></em></p>
<p><em><span style="color: #0000ff;">At the time, Palin had been tapped as running mate to Republican U.S. Sen. John McCain in his failed 2008 presidential campaign, and national media were alleging Palin used the private e-mail account to keep gubernatorial business from the public&#8217;s prying eyes.</span></em></p>
<p><em><span style="color: #0000ff;">Federal prosecutors Greg Weddle and Mark Krotoski on Thursday zeroed in on one of four felony charges Kernell faces &#8211; obstruction of the FBI&#8217;s probe. They sent Kernell friend Benjamin Reed to the witness stand to recount how Kernell worried the FBI was on his trail and openly pondered the merits of reformatting his hard drive.</span></em></p>
<p><em><span style="color: #0000ff;">But the crux of their obstruction case came from testimony by McFall, a computer expert so skilled he was tapped to help organize the FBI&#8217;s elite Computer Analysis and Response Team, or CART.</span></em></p>
<p><em><span style="color: #0000ff;">McFall said his probe was stymied by a series of steps authorities allege Kernell took to cover his tracks, including deleting from the computer material gleaned from Palin&#8217;s account, clearing his Internet history on one Web browser, uninstalling another browser and running a Windows tool designed to speed a computer up by overwriting space occupied by deleted files.</span></em></p>
<p><em><span style="color: #0000ff;">&#8220;Uninstalling (software) and deleting a bunch of files and photos, then defragmenting, makes it a whole lot (tougher)&#8221; to reconstruct whatever evidence the laptop contained, he said.</span></em></p>
<p><em><span style="color: #0000ff;">But McFall did get a probe assist from an unexpected source &#8211; a nasty virus hiding on the used laptop Kernell&#8217;s aunt and uncle gave him to use in his UT studies. &#8220;It&#8217;s designed to collect a lot of different data (including) banking and finance data,&#8221; he said.  The &#8220;malware&#8221; created a log of much of Kernell&#8217;s Internet activity, he said. &#8220;The log file was capturing, almost like a surveillance camera, the activities that were going on,&#8221; he said.</span></em></p>
<p><em><span style="color: #0000ff;">Prosecutors used McFall&#8217;s testimony to paint a portrait of a self-described &#8220;Obamacrat&#8221; bent on derailing the Republican campaign who tried to cover his tracks when the illegal access went public. But defense attorney Wade Davies used it to try to advance his contention the high-profile e-mail compromise was nothing more than a college prank spurred by curiosity and carried out by an immature student with less-than-savvy computer skills.</span></em></p>
<p><em><span style="color: #0000ff;">For instance, Davies noted in cross-examination that Kernell did not delete a draft of an Internet post in which he boasted of the ease with which he cracked the account.  &#8220;I am the (discussion board) lurker who did it, and I would like to tell the story,&#8221; the file read.</span></em></p>
<p><em><span style="color: #0000ff;">Davies also pointed out that minutes after Kernell posted the new password he set for the account on that same discussion board, McFall&#8217;s laptop probe shows he tried to change it again in an effort so frantic he made a series of sloppy mistakes that kept him from doing so. He also highlighted to jurors a Facebook chat with Reed in which Kernell wrote that he &#8220;posted the pass(word) like a dip (expletive).&#8221;</span></em></p>
<p style="text-align: center;"><em><span style="color: #0000ff;">Palin and her husband, Todd Palin, are on the government&#8217;s witness list and could testify today.</span></em></p>

You’ll find the name Goldman Sachs on many an Obama administration résumé, including Rahm Emanuel’s and Tim Geithner’s chief of staff’s.</p>
<p>We need to be on our guard against such crony capitalism. We fought against distortion of the market in Alaska when we confronted “Big Oil,” or more specifically some of the players in the industry and in political office, who were taking the 49th state for a ride. My administration challenged lax rules that seemed to allow corruption, and we even challenged the largest corporation in the world at the time for not abiding by provisions in contracts it held with the state. When it came time to craft a plan for a natural gas pipeline, we insisted on transparency and a level playing field to insure fair competition. Our reforms helped reduce politicians’ ability to play favorites and helped clean up corruption. We set up stricter oversight offices and ushered through a bi-partisan ethics reform bill. Far from being against necessary reform, I embrace it.<br />

<p>Opening day of the Palin E-Mail Hacker Trial brought about some interesting revelations:</p>

<li>Among the jurors hearing the proof are a Baptist preacher, a software expert, a farmer, a recent community college graduate, a photography buff, a couple of foster parents and a transplanted resident originally from Milwaukee, WS.</li>
<li>Sarah’s daughter, Bristol, testified about the threatening calls she received after her private cell phone number was released publically via the hacked e-mails.  As reported by the KNOXVILLE NEWS, where the trial is being held: </li>

Sarah Palin told jurors she was barraged by calls and texts after her number wound up on the Internet in 2008 courtesy of someone illegally accessing her mom&#8217;s e-mail account. &#8220;I got a few anonymous phone calls,&#8221; Bristol Palin testified. &#8220;I checked my caller ID. It said an unknown number. When the phone calls kept coming through the night, it got more suspicious &#8211; different tones of voice, different area codes.&#8221;</span></em></span></p>

<li>Bristol Palin&#8217;s cell phone number was included in a screenshot of Sarah Palin&#8217;s inbox that wound up on the Internet and, later, broadcast news networks. Bristol said her phone was essentially under siege for a week before she turned it over to the U.S. Secret Service.</li>
<li>It was revealed Governor Palin’s wonderful parents also suffered through crank calls and threats as a result of the hacking.</li>

<p>The defendant, Mr. Kernell is a child of privilege and his father has served as a Democrat in the Tennessee Legislature since election in 1974.  His attorney argued that Kernell was merely being curious and never believed a prominent political figure like Palin would use a poorly protected Yahoo! account. (YAHOO, of course, claims they have layer-upon-layer of security.) &#8220;This is a case about a prank, not a crime…the evidence will show he acted out of curiosity.&#8221;</p>

<p>Oddly, young Mr. Kernell made an oddly snarky remark upon leaving the courthouse when he was asked his opinion of Bristol Palin.  His answer:  “Not my type.”  For a young man facing charges that could lead to 50 years in prison that’s a rather flip response.  He is charged with four felonies including identity theft and wire fraud.</p>

<p>According to the WASHINGTON POST:</p>

<p>PALIN PANIC on the part of national media pundits is sometimes amusing to watch.  I mean, how many times can you declare someone ‘politically dead’ and then keep covering them with such worried fervor?</p>
<p>However, we supporters of Governor Palin need to be aware the media is now attempting to label her ‘unelectable’.  This manifests itself in many ways. </p>
<p>Some of this is repeating interviews with one or two people at her recent New Orleans speech who say they ‘love her’ but she can’t be elected.  (Of course what is not repeated were the hundreds of people in New Orleans who support her and want her to run.)</p>
<p>The repetition of anti-Palin comments this past ten days has been remarkable…sort of like repeating the same baseball score from a game two weeks ago as ‘news’.</p>
<p>Similarly, the always laughable ABC NEWS/WASHINGTON POST polls allegedly found high negatives for Palin’s electability about two months ago.  Since that time nearly EVERY left wing talking head, elitist columnist and network anchor have repeated the poll. </p>
<p>Again, in the political world ABC/WASHINGTON POST polls are always considered a ‘joke’.  For years these polls have over-sampled liberal Democrats and under-sampled conservative Republicans to affect a pre-determined result.  Of course, busy voters have long forgotten the results by Election Day when proof surfaces of how fraudulent they are.</p>
<p>Unfortunately though, some people on our side of the political spectrum are buying into this ‘concern’ Palin could not defeat Obama.  They forget the object of scorn and derision heaped upon Ronald Reagan when he waged Presidential campaigns in 1976 and again in 1980. </p>

<p>He was way down in the polls, referred to as an intellectual inferior and unversed in foreign policy. Well, we all know the result of the 1980 election and the subsequent history changing years of the Reagan Administration.  More reliable polls taken in the past three months have Sarah Palin running anywhere from 2-to-13 points behind Obama in head-to-head matchups. </p>
<div class="mceTemp">This is a lot better than Ronald Reagan did at the beginning of his campaigns.  For Palin, after such unprecedented media attacks on her every move, it is amazing she is polling so well.</div>
<p>It’s also true polls this far ahead of the 2012 election are somewhat meaningless.  We do not know what national and international forces will be in play during that election year.  However we already know something very important about the dynamics for 2012: Sarah Palin get under the skin of Barack Obama.</p>
<p>This point is very important because much like President Jimmy Carter and the liberal media in 1980…they will fall into the trap of ridiculing an opposing candidate who connects directly to the majority of conservative voters in our nation.  We’ve seen Obama is nearly incoherent when he is directly challenged.  Sadly, none of the other potential candidates has shown any courage in taking the President on as Palin has.  In a debate, she will tie him in knots. </p>

<p>But, the debates are a show for another day.  What we must all do today is combat this idea of un-electability.  We need to remind our friends, family and business colleagues Palin can prevail just as Ronald Reagan did. </p>

<p>But to reach that point, Ronald Reagan faced down his detractors in the media and the GOP.  He was nearly knocked out of the race by a loss to George Bush in the Iowa Primary and his campaign was on life-support before besting him in New Hampshire. </p>
<p>So, let us steel our spines and fight back against those inside the White House and network newsrooms attempting to politically ‘kill’ Sarah Palin before she gets started for 2012.</p>

<p>The success of a Palin Presidential campaign is in our hands.  We need to assure Sarah if she decides to enter this battle that we will be the courageous soldiers who will not cut and run when challenged. </p>

<p>Sadly for the nation, and all who cherish America, he is a man driven by self-congratulations, of government favors and an insecurity normally reserved for those who seek their own gain over that of those around them.</p>
<p>Perhaps no words better convey the difference between a great leader like President Ronald Reagan than those delivered at the 1988 GOP Convention in New Orleans during his final months in office. </p>
<p>He identified, with his ever present humility, the understanding he was a servant of the people and the presidency was a temporary station in life bestowed upon him by the people. </p>
<p>It would be well to contrast President Reagan’s simple words than those most recently uttered by President Obama&#8230;suggesting the American people should than ‘HIM’ for all he has done for us. </p>
<p> In doing so, Obama secured his place far down the chain of American Presidents and he will be so judged in time.  For now, please provide yourself with encouragement from the words of a great leader:</p>

<p>Presidential arrogance is never pretty.  The great Presidents, such as Ronald Reagan, speak of being temporary custodians of the office there to work on behalf of the American people and not the Federal government.</p>
<p>However, President Obama’s already healthy arrogance and ego, made more so by a worshipful left wing news media, took a new and ugly turn last night.  In an address before 1000 big Democrat donors at a fundraiser, Obama slammed the Tea Party movement and then suggested they should really ‘thank him’ for lowering taxes!  Yes, you read that right.  Here is the news account of the President’s words:</p>
<p style="text-align: center;"><span style="color: #0000ff;"><em>&#8220;I&#8217;ve been a little amused over the last couple of days where people have been having these rallies about taxes,&#8221; the president said, noting the numerous tax cuts pushed by his administration. &#8220;You would think they&#8217;d be saying thank you.&#8221;</em></span></p>
<p>He then went on to tell this fiction about his ObamaCare bill:</p>
<p style="text-align: center;"><span style="color: #0000ff;"><em>&#8220;For all the sound and fury and all the scare tactics&#8230; the law doesn&#8217;t hand more control to the government,&#8221; the president said, &#8220;it gives it back to you, the American people.&#8221;</em></span></p>

<p>This is not only Presidential arrogance it is also blindness.  He has absolutely no idea what the American people feel about his tax policy, deficit policy and healthcare fiasco.  He continues to be a ‘President’, in his own mind, of only one side of the political spectrum.</p>
<p>It is a rare, peculiar and absolutely dangerous outlook which pretty much says to taxpayers:  “The public be damned.  The media will protect me.  The media will slander my opponents and I will be a ‘transitional’ President by so changing American life I can achieve what I want in just one term if necessary.”</p>
<p>What we have is the great liberal ‘playbook’ in place.  You stage big events that are long on pageantry and short on substance.  (The recent ‘nuclear summit’ was a case in point.)  Then you have your media friends print multiple stories of how you are a President just like Reagan seeking to rid the world of nuclear weaponry.  (Though the two periods of history are hardly comparable and Reagan did not give up strategic American defense as Obama did.)</p>
<p>The other part of the liberal playbook is to continually say things you know are not true and assume the media will cover for you.  This is true of calling increased federal spending as budgetary restraint.  The President identifies tax increases as tax cuts and then tells us more government is really less government.</p>
<p>So, what does this say to us?  It says we need to redouble our efforts to engage friends, family and business colleagues or clients with the political process THIS YEAR.  This is the year we need to show muscle and resolve.  Our goal is a simple one:  We will 40 House seats and Pelosi is deposed and the President’s policies neutered.  It also means ObamaCare can be defunded and slowly killed.</p>
<p>As for the President we can only shake our heads with disbelief.  He and his supporters continue to belittle, ignore and demean the Tea Party movement and millions of other Americans who are fed up with big government and the path to national financial ruin.</p>

<p>The debate is on:  Will it be Obama’s Arrogance or the Common Sense of the American people and Sarah Palin?  It’s in our hands to decide.  If you are reading this article and have not yet volunteered for a Congressional campaign in your state then chances are Obama will be the victor in November. If you are a campaign volunteer, let us say ‘thank you’ for taking a stand for the priceless value of American liberty.  This is our battle to win or lose.  Let’s go out and win big and take some of the arrogance out of this immature President.</p>
